Refugee Claimant

The category of Refugee Claimant covers a person who is outside his/her country of origin and has a well-founded fear of persecution based on his/her race, religion, nationality, political opinions or membership in a particular social group. In addition, the Immigration and Refugee Protection Act defines the type of person that needs protection as a person in Canada whose return to their home country would expose them personally to a risk of torture, a threat to their life, or a risk of cruel and unusual treatment and punishment.

Once they achieve recognition as a refugee or an individual requiring protection, they have the right to apply for permanent residence, from within Canada.
